'An important contribution to the fields of feminist jurisprudence and feminist theory' - Mary Anne Bobinski, University of Houston Law Center. "Pregnant Men" explores how one can combine feminist practice and theory. It shows how to implement anti-essentialist and equality perspectives in teaching, writing, and the practice of law. Drawing experience from her work as a litigator, teacher, and writer, Colker discusses her legal work on behalf of pregnant women and gay and lesbian people; her teaching in a wide range of contexts, from civil procedure to feminist jurisprudence. The personal stories she tells are themselves fascinating, but they also demonstrate Colker's model of a more practical feminist theory. Colker's examples illuminate current debates in feminist theory. She demonstrates the difficulty of using equality theory in the reproductive health context because there are no 'pregnant men'. By examining cases involving men who are similarly situated to pregnant women, Colker provides us with an original way to show that pregnant women are, in fact, treated far worse than 'almost-pregnant' men. Relying in part on the academic writings of Justice Ruth Bader Ginsburg, Colker moves feminist theory in a practical direction with the hope that some of these ideas might be implemented under the newly constituted United States Supreme Court.
